Questioner: May one's father's wife be given zakat?
The brother asks whether one's father's wife may be given zakat or not. The tie that binds a person to his father's wife is a tie of marriage-relation (sihr). The women prohibited [in marriage] by marriage-relation are four — who among you knows them? Only four are prohibited by marriage-relation: the father's wife; the wife's mother; the son's wife; and the wife's daughter who is in your care. These are four prohibited women; there is no fifth. The father's wife is one of them. She is prohibited by marriage-relation — not by lineage and not by milk kinship (rada').
Being good to her is being good to the father, because of his statement ﷺ, "The finest act of filial piety is that a man maintain ties with the loved ones of his father," recorded by Muslim in his Sahih. So if the father's wife was beloved to the father, then being dutiful to her, maintaining ties with her, and drawing near [to Allah] by being good to her is dutifulness and goodness toward the father, whether this be during his life or after his death. Ibn 'Umar, may Allah be pleased with him, used to be good to the relatives of 'Umar and would go to great lengths in that, citing this hadith as his evidence.
If the father's wife is in need, it is better that she be given from voluntary charity (sadaqah) and treated well as far as possible. If a person is not inclined to give her from voluntary charity, there is no harm in paying zakat to her. Why? Because you are not obliged to provide for her maintenance, and whoever you are not obliged to maintain may be given zakat. This is a principle: everyone whose maintenance is not obligatory upon you may be given zakat — whether this zakat is for paying off her debts, or for her food, drink, and living expenses.

السائل: زوجة الأب، هل تُعطى من الزكاة؟
الأخ يقول: زوجة الأب هل تُعطى من الزكاة أو لا؟ الصلة التي تربط الشخص بزوجة أبيه هي صلة الصهر. المحرّمات من الصهر أربع، من يعرفها منكم؟ ما حرُم من الصهر إلا أربع فقط: زوجة الأب، وأمّ الزوجة، وزوجة الابن، وبنت الزوجة التي في حجرك. فهذه أربع محرّمات، لا خامس لهن، وزوجة الأب إحداهن، فهي محرّمة بالصهر، لا بالنسب ولا بالرضاع.
والإحسان إليها يكون إحسانًا إلى الأب؛ لقوله صلى الله عليه وسلم: إن أبرّ البرّ أن يصل الرجل أهل ودّ أبيه، رواه مسلم في صحيحه. فإذا كانت زوجة الأب محبوبة للأب، كان البرّ بها وصلتها والتقرّب بالإحسان إليها برًّا بالوالد وإحسانًا إليه، سواء كان هذا في حياته أو بعد مماته. وقد كان ابن عمر رضي الله عنهما يُحسن إلى أقارب عمر، ويبالغ في ذلك، ويستدل في هذا بهذا الحديث.
فإذا كانت زوجة الأب محتاجة كان الأولى أن تُعطى من الصدقات، ويُحسَن إليها بقدر الإمكان، وإذا لم تطِب نفس الشخص بأن يعطيها من الصدقات فلا بأس بدفع الزكاة إليها. لماذا؟ لأنه لا تجب عليك نفقتها، ومن لم تجب عليك نفقته جاز إعطاؤه من الزكاة. وهذه قاعدة: كل من لم تجب عليك نفقته فإنه يجوز إعطاؤه من الزكاة، سواء كانت هذه الزكاة لقضاء ديونها، أو لأكلها وشربها ونفقاتها.
