Ruling on Purification for Tawaf Around the Ka'bahحكم الطهارة للطواف بالكعبة
Questioner: Is purification a condition for the sunnah of tawaf around the Ka'bah, or merely recommended?
The majority require purification for tawaf from both major and minor ritual impurity, and cite a number of evidences for this. Among them: that when the Prophet ﷺ wished to perform tawaf, he performed wudu, recorded by al-Bukhari in his Sahih; and that the Prophet ﷺ said to 'A'ishah, "Do what the pilgrim does, except that you may not perform tawaf around the House," a hadith agreed upon, which indicates that purification from major ritual impurity is a condition for the validity of tawaf. They also cite the hadith of Ibn 'Abbas, marfu' (raised to the Prophet ﷺ): "Tawaf around the House is prayer" — though its chain is disputed. The requirement of purification from both types of impurity for tawaf is the view of the majority and the position of the four schools — Abu Hanifah, Malik, al-Shafi'i, and Ahmad — though they differ in detail over the case of one who performs tawaf in a state of major impurity out of forgetfulness, which is a separate matter. As for minor impurity, they likewise hold that one may only perform tawaf in a state of wudu, treating minor impurity as they treat major impurity, on the basis of the hadith of Ibn 'Abbas: "Tawaf around My House is prayer."
The second view in this matter is that purification from major impurity is obligatory for tawaf, based on the evidences already mentioned, but that no explicit, reliable text establishes an obligation of purification from minor impurity. The fact that the Prophet ﷺ performed wudu before tawaf is merely an action, and an action indicates recommendation rather than obligation, in the view of the majority of the scholars of usul, though this too is disputed. As for the hadith of Ibn 'Abbas, "Tawaf around the House is prayer," the response is twofold: first, the report is defective, and the correct position is that it is a statement of Ibn 'Abbas himself (mawquf) rather than something raised to the Prophet ﷺ; second, even granting its authenticity, it does not clearly indicate that wudu is a condition for tawaf. His saying that tawaf around the House is prayer does not mean that it shares every ruling of prayer, since prayer requires facing the qiblah, which tawaf does not; speech invalidates prayer, whereas speech is permitted during tawaf and does not invalidate it; and if the prayer is established while one is performing tawaf, it is permissible to pray and then either resume the tawaf or begin again from where one left off, whereas nothing of this kind is valid in prayer itself. Tawaf, then, does not resemble prayer in every respect, and the view that wudu is not a strict condition is the stronger one — though a person should not act upon this except when there is a genuine need for it, such as when one loses wudu amid the crowding at times of congestion and is unable to leave to perform wudu, especially if accompanied by others whom leaving would inconvenience. When there is no such need or impediment, one should not perform tawaf except in a state of wudu, so as to remain clear of scholarly disagreement — "leave what raises doubt for what does not raise doubt," as the poet said, and "the most scrupulous is one who leaves what is disputed, even if weak, and keeps clear of it." This is the position chosen by Shaykh al-Islam Ibn Taymiyyah, may Allah have mercy on him.

سُئل: هل تُشترط الطهارة لصحة الطواف بالكعبة أم هي مستحبة؟
الجمهور يشترطون الطهارة للطواف من الحدث الأكبر والحدث الأصغر، ويستدلون على ذلك بأدلة كثيرة، فمن ذلك: أن النبي صلى الله عليه وسلم لما أراد أن يطوف توضأ، وهذا خرّجه البخاري رحمه الله تعالى في صحيحه. ومن ذلك أن النبي صلى الله عليه وسلم قال لعائشة: افعلي ما يفعل الحاج، غير ألا تطوفي بالبيت، وهذا متفق على صحته، وهو دليل على أن الطهارة من الحدث الأكبر شرط لصحة الطواف. ويستدلون أيضًا بحديث ابن عباس مرفوعًا: الطواف بالبيت صلاة، إلا أنهم تكلموا في إسناده. والقول بوجوب الطهارة للطواف من الحدثين هو قول الجمهور، وهو مذهب الأئمة الأربعة: أبي حنيفة، ومالك، والشافعي، وأحمد، إلا أن لهم تفصيلًا في مسألة من طاف جنبًا ناسيًا، وهذا باب آخر. وأما الحدث الأصغر فيقولون بذلك أيضًا، أنه لا يطوف إلا متوضئًا، فيُلحقون الحدث الأصغر بالحدث الأكبر، بحديث ابن عباس: الطواف ببيتي صلاة.
والقول الثاني في المسألة: أن الطهارة من الحدث الأكبر واجبة للطواف؛ للأدلة المتقدمة، وأما من الحدث الأصغر فلم يثبت نص صريح يُعتمد عليه في هذا. فكونه صلى الله عليه وسلم توضأ، هذا فعل، والفعل يدل على الاستحباب في قول جمهور الأصوليين، وفي هذا أيضًا خلاف. وأما حديث ابن عباس: الطواف بالبيت صلاة، فالجواب من وجهين: الوجه الأول أن الخبر معلول، والصواب وقفه على ابن عباس، ولا يصح رفعه. الوجه الثاني: أنه لو صح، فليس فيه دلالة واضحة على اشتراط الوضوء للطواف؛ فكونه قال: الطواف بالبيت صلاة، لا يعني أنه بمنزلة الصلاة من كل وجه؛ بدليل أن الصلاة يُشترط لها استقبال القبلة، وهذا لا يُشترط له، وبدليل أنه يحرم الكلام في الصلاة ويبطلها، وهذا يجوز فيه الكلام ولا يبطل به، وبدليل أنه لو أُقيمت الصلاة وأنت تطوف، جاز أن تصلي ثم تستأنف الطواف بعد ذلك أو تبني من حيث وقفت، وهذا لا يصح مثله في الصلاة. فهو لا يشبه الصلاة من كل وجه، والقول بعدم اشتراط الوضوء أقوى، ولكن لا يفعل الإنسان ذلك إلا وقت الحاجة إليه، كأن يُحدث في أوقات الزحام ولا يستطيع أن يخرج فيتوضأ، خاصة إذا كان معه رفقة يُعطّلهم بخروجه. وإذا لم يكن هناك حاجة ولا مانع، فإنه لا يطوف إلا متوضئًا، خروجًا من خلاف العلماء. دع ما يريبك إلى ما لا يريبك، كما قال الناظم: وإن الأورع الذي يخرج من خلاف ولو ضعيفًا فاجتنبه. وهذا القول الذي ذُكر هو اختيار شيخ الإسلام ابن تيمية رحمه الله تعالى.
