The brother asks about a man who divorced his wife once and her waiting period ('iddah) ended, or divorced her twice and her waiting period ended, [or] divorced her three times; then she married another man, then the second [husband] divorced her, and she returns to the first. Does she return to the first — if she had been divorced once or twice — with the two divorces? Or does she return to the first with [all] three divorces, in the sense that it is as if he were newly married to her? There are two views among the scholars, two views among the jurists.
The first view: that the divorces that have passed [count] against her, because the two divorces are established as his due with respect to one woman, and her having married [another] — the marriage does not demolish what has passed. This is a view of 'Umar ibn al-Khattab, a view of Abu Hurayrah, may Allah be pleased with him, and a narration from Imam Ahmad.
The second view on the matter: that she returns to the first with three, as though he had not divorced [her]. This is the more correct of the two views. It is also a view of 'Umar, and a narration from Imam Ahmad. The evidence for this view is that, as long as the second [husband] demolishes the three, he demolishes the first and demolishes the second. If we have agreed that he demolishes the three, then why would he not demolish the first and not demolish the second? For that reason, she returns to the first with [all] three divorces.

الأخ يسأل عن رجل طلّق زوجته طلقة فانقضت عدتها، أو طلّق طلقتين فانقضت عدتها، [أو] طلّقها ثلاثًا، ثم تزوّجت برجل آخر، ثم طلّقها الثاني، فتعود إلى الأول. هل تعود إلى الأول — إذا كانت مطلّقة طلقة أو طلقتين — بالطلقتين؟ أو تعود إلى الأول بالطلقات الثلاث، على معنى كأنه حديث عهد بزواج بها؟ فيه قولان للعلماء، وقولان للفقهاء.
القول الأول: أن ما مضى من طلاقها عليها؛ لأن الطلقتين ثابتتان في ذمته لامرأة واحدة، وكونها تزوّجت فإن الزواج لا يهدم ما مضى. وهذا قول لعمر بن الخطاب، وقول لأبي هريرة رضي الله عنه، ورواية عن الإمام أحمد.
القول الثاني في المسألة: أن ترجع [إلى] الأول بالثلاث، كأنه لم يطلّق. وهذا أصح القولين، وهو قول لعمر أيضًا، ورواية عن الإمام أحمد. والدليل على هذا القول: أنه ما دام الثاني يهدم الثلاث، يهدم الأولى ويهدم الثانية؛ إذا اتفقنا على أنه يهدم الثلاث، فلماذا لا يهدم الأولى ولا يهدم الثانية؟ فلذلك ترجع إلى الأول بالطلقات الثلاث.
