Is a Man a Mahram to the Wife of His Son Through Milk Kinship (Rada')?
(An exchange with an attendee, partly unclear.)
Questioner: His statement, exalted is He… (audio unclear)
There is a difference between — are you asking about the verse or about the mahram? It has no connection to being a mahram? What are you asking about? The daughter — the one who is the son's wife? That is well known. What are you asking about, exactly? The son's wife — is she (audio unclear) forbidden? The son through milk kinship? A mahram for the father?
Questioner: I have a son through milk kinship.
Yes.
Questioner: His wife.
Yes. The son's wife: someone who has a son through milk kinship (rada'), and [that son] married — is the wife of his son, the one who is his son through milk kinship, a mahram [to him]? Or is he a mahram to his son's wife?
There are two views among the scholars on this, and it is built upon the meaning of the statement of Allah, majestic and exalted is He: "And the wives of your sons who are from your [own] loins." A group has asserted that His statement "from your loins" is a condition: if [the son] is not from the loins, he is not a mahram to her. A group of the people of knowledge went to this; it is the view of the Zahiris, and it is the meaning of the statement of Shaykh al-Islam Ibn Taymiyyah, may Allah have mercy on him. The majority say: the son from the loins is mentioned (audio unclear) adoption — the majority say: the son from the loins is mentioned in order to exclude the adopted son.
The majority say that the father of this man, even if [he is his father] through milk kinship, is a mahram to his wife. Shaykh al-Islam prohibits this — indeed, he prohibits what is further than this. Shaykh al-Islam, may Allah have mercy on him, says that a brother through milk kinship is not permitted to be alone with his sister, because the incentives of desire are present. And it does not mean that, if he is a mahram, he may be alone with her and travel with her.
Consequently, in this scenario we take precaution on one side and take precaution on the other. We say: he is not to be alone with her, nor [is he] a mahram to her; and at the same time (audio unclear) marriage between them. We take precaution on one side, and we take precaution on the other side.
