Selling and Renting Out Houses in Makkah and Madinah

Questioner: O Shaykh, renting in Madinah — what is the preponderant view?

Houses and the like?

Questioner: Yes, renting.

Madinah and Makkah are all the same. According to the correct view, it is permissible to sell its houses and rent out its properties; and likewise in Madinah it is permissible to sell its houses and rent out its properties. This is what the authentic hadiths indicate, and nothing authentic has come contradicting them.

What is forbidden is renting out or selling the endowment (waqf) — that is, what Allah has endowed for His servants, such as the sites of the rites. The sites of the Muslims' rites are not rented out, by consensus. Renting in 'Arafat, for example, is forbidden by consensus; renting in Muzdalifah is forbidden by consensus; renting in Mina, for example, is forbidden by consensus — because this is Allah's endowment for His servants. These are sites where the servants establish their religion and perform their rites; they are not sold, bought, or rented out.

As for houses that a person owns and the like — the Prophet ﷺ says: "Has 'Aqil left us any dwellings?" — meaning that he had taken ownership. Whenever he owns it, he may sell it and buy.

Questioner: He says, "Has 'Aqil left us any dwellings?" — it is the house of the Prophet ﷺ; how did he take it?

It is not the house of the Prophet ﷺ; rather he inherited it from his uncle. The Prophet did not have a house in the first place.

A student: O Shaykh, he thinks that 'Aqil seized it from the Prophet ﷺ by force.

No, no. 'Aqil inherited from his father. That is why 'Ali did not inherit from him, because 'Ali was a Muslim, and 'Aqil inherited from him because he was a disbeliever.
