Combining Prayers While Travelling for Hunting or Recreation, and Combining Due to Genuine Necessityالجمع والقصر في السفر للصيد أو النزهة، والجمع للحاجة

Questioner: Is there a difference between travelling for hunting and travelling for recreation with regard to shortening and combining prayers over a distance of eighty or a hundred kilometres?

There is no difference between travelling for hunting and travelling for recreation in this regard. The difference only appears in certain schools when the journey itself is undertaken for a sinful purpose — some jurists do not permit making use of travel concessions on a forbidden journey. But travelling for hunting or for recreation is subject to the ordinary rulings of travel. The majority hold that the distance must be roughly four barid (about eighty to ninety kilometres), and what matters is not merely a technical distance but whether the trip is genuinely considered "travel" in common usage — if it is called travel, the prayer may be shortened and combined whether the distance is under or over eighty kilometres; what matters is whether it is customarily termed travel, regardless of whether it is framed as an excursion or a trip.

As for combining prayers, this is not tied specifically to the distance of travel. One may combine due to severe cold, due to scarcity of water, or due to other genuine needs — combining is not exclusive to the traveller. Even while resident, if there were severe cold that made performing wudu for every single prayer genuinely difficult, combining would be permitted; or if water became scarce and people needed to combine the two prayers, that too would be permitted. Further still: a cook who fears his food will burn, or a baker who fears his bread will burn, may delay Dhuhr until 'Asr, or Maghrib until 'Isha — though this does not mean he continues serving customers throughout that time; rather, he should close his shop temporarily to attend to his work, then pray. These, however, are rare situations; one who uses this excuse habitually and continuously cannot rely on it, since a genuine need must be occasional, not a permanent state of affairs.

سئل عن حكم قصر الصلاة والجمع فيمن يذهب للصيد أو للنزهة مسافة ثمانين أو مئة كيلومتر، وهل يُفرَّق بين السفر للصيد والسفر للنزهة؟

الجواب: لا فرق بين الذهاب للصيد والذهاب للنزهة في هذا الباب؛ إنما يظهر الفرق عند بعض المذاهب حين يكون السفر نفسه سفر معصية، فبعض الفقهاء لا يُجيزون استصحاب رخص السفر في السفر المحرَّم. أما السفر للصيد والسفر للنزهة فتُطبَّق عليهما أحكام السفر المعتادة. والجمهور يشترطون مسافة أربعة برد تقريباً، ولا يعتبرون الأمر بمجرد التسمية، بل بتحقق كونه سفراً فعلاً؛ فإن كان يُسمّى سفراً فيُقصَر ويُجمع سواء كان دون الثمانين أو فوقها، فالمعتبر هو تسميته سفراً عرفاً، بغض النظر عن كونه رحلة أو نزهة.

وأما الجمع فلا علاقة له بمسافة السفر خاصة، فقد يُجمع لشدة البرد، وقد يُجمع لقلة الماء، وقد يُجمع لحاجات أخرى؛ فالجمع لا يختص بالمسافر وحده. فنحن الآن مثلاً - في الحضر - لو كان هناك برد شديد يشقّ معه الوضوء لكل صلاة، جاز الجمع، أو لو قلّ الماء عند الناس فاحتاجوا إلى جمع الصلاتين، جاز ذلك أيضاً. وأكثر من ذلك: الطبّاخ الذي يخشى أن يحترق طعامه، أو الخبّاز الذي يخشى أن يحترق خبزه، يجوز له أن يؤخّر الظهر إلى العصر، أو المغرب إلى العشاء، لكن ليس المعنى أن يستمر في فتح محله وبيعه على الناس أثناء ذلك؛ بل يُغلق محله مؤقتاً حفاظاً على عمله، ثم يصلي. وهذه تكون حالات نادرة، أما من يتعذر بذلك دائماً فيمتنع عليه هذا العذر، لأن الحاجة العابرة غير الدائمة.
